Of course, ARPA! No question. But NPS wants to throw the book at these A--H----S! Give them time to think of all the OTHER things they can charge them with! I bet there are a dozen other NEPA-related crimes.

Do you know what the mandatory first offense for an ARPA violation is? (Oh, hell, where IS that manual I photocopied on my own dime over my lunch hour before I retired? Oh, yeah, still out in the garage, where it never got unpacked...) Anyway, mandatory penalties, although coming up in the world, are still not all that high. Stealing government property gets a slightly stiffer penalty, if you can convince a federal judge that old bullets and rusty junk is worth his time on the bench (hence the NEED for mandatory sentencing in ARPA violations....).

THAT'S why NPS needs to charge the creeps with SEVERAL crimes (all of which they DID commit) and hope that ALL of them stick.

  whatever. I don't think the Nuremburg Defense would work here, either.

  No, David and I are not related.  BUT !  He owes me an NPS job BIG TIME for
  the use of the family name!  ;o)

  I believe NPS spokesman David Barna (any relation?) said solicitors from
  Interior were working with Justice to figure out whether to bring criminal
  charges as well as civil charges gains the developers.

  Sounds to me like folks are putting their heads together to figure out how
  to throw the books at these creeps.

  If a ranger had arrested the guy driving the bulldozer, what would he have
  arrested him for? ARPA violation? Destroying government property? We all
  know it wasn't the equipment operator who was the criminal here. Or the
  construction supervisor. Give NPS a break. Let them figure out who to
  prosecute and what suite of crimes to charge them with.
