The governing body of WHO, the World Health Assembly, meets regularly to
discuss issues of interest to all member states.
WHO has no power within countries to penalize anyone for violation of the
code on marketing of breastmilk substitutes. The signatories of the code
were encouraged to enact legislation in their own countries that would make
it a crime to violate the code. To date very few countries have done so.
Many countries have voluntary regulations with wording like the code,
respected by industry, at least as long as anyone is watching. Article 11
of the code itself addresses the issue of monitoring.
In the code itself, voluntary organizations are actually designated among
the watchdogs for code violations.
