Thank you so much for posting this. In case there are any who are wondering...This decision is from the 5th Circuit. What one Circuit Ct. (federal ct.) decides is not binding law on other circuits, but it is considered "persuasive" when the other circuits are making their decisions. I am happy to note that the 5th Circuit's decision was unanimous.
